Jonathan Kay on Richard Warman and Canada's phony-racism industry

Canadians now know the precise moment when radical anti-racism became a more powerful sociological toxin than racism itself: 7:55pm EST on Sept. 5, 2003.

That is the date-stamp on a particularly vile posting, left by an anonymous user on the message board of the right-wing web site freedomsite.org, attacking Canada’s first black senator. It read as follows: “Not only is Canadian Senator Anne Cools is a Negro, she is also an immigrant! And she is also one helluva preachy c*nt. She does NOT belong in my Canada. My Anglo-Germanic people were here before there was a Canada and her kind have jumped in, polluted our race, and forced their bullshit down our throats. Time to go back to when the women *** imports knew their place … And that place was NOT in public!”


Horrible, shocking stuff. But even more shocking is the identity of the fellow whose electronic fingerprints were all over the message: famed Canadian human-rights lawyer Richard Warman.


Warman is a legend in anti-racism circles. A former member of the Canadian Human Rights Commission, he’s launched countless complaints against right-wing extremists, and won almost all of them. But during proceedings surrounding one of Warman’s 2003-era complaints against freedomsite, the respondents turned the tables. A computer expert named Bernard Klatt did some digging under freedomsite’s back office, and determined that the Cools posting had been made from a computer bearing the IP address 66.185.84.204, the very same address from which Warman had admitted to visiting freedomsite using a different alias.


Other technical details – such as the operating system and Web browser being used – also provided an exact match to Warman. Based on this evidence, Klatt concluded in a recently publicized affidavit, “Richard Warman was the poster of the message headed ‘Cools don’t belong in our Senate.’ ”


Does this mean Warman is a closet bigot? I doubt it. What seems more likely is that – like other anti-racism activists – Warman simply found himself running out of Aryan Nation types to chase around the Internet. And so, under this theory, he decided to just start typing the stuff up on his own computer – and then added these self-authored “racist” postings to his blunderbuss brief against freedomsite. (As Klatt notes, Warman has been accused of perpetrating the same sort of stunts on other right-wing Web sites.) When you’ve got profitable hate-speech cases to prosecute, why wait for some unemployed conspiracy theorist to start raving against immigrants when you can just manufacture the evidence yourself?


Bizarre as this episode may be, it is of a piece with a larger trend – symbolized, south of the border, by the shamefully trumped up case against the Duke University lacrosse team. The anti-racism industry, running out of legitimate hatemongers to go after, has gone rogue in its search for attention and relevance.


It also raises the question: How many other faux-racist frauds are out there? Thanks to Warman, it's a question I now think about every time a Canadian hate-speech activist or blogger publicizes an email he gets from some whitepower22@hotmail.com or other. These poisonous messages are held up as dramatic proof that there are still plenty of Nazi types out there – and that without hate-speech laws to shut them up, the country’s gays, Jews, Black and Arabs will remain at risk of verbal assault, or worse. But if the picking are so slim that anti-racists have slid into second careers as fiction writers, what does that say about the scale of the problem? How many of the other examples of “hate” that you see out there are similarly bogus?


The anti-racism industry has become an industry like any other: As the actual need for what its peddling has diminished in this extraordinarily tolerant nation, the industry’s various profiteers and carnival barkers have created myths and exaggerated fears to prop themselves up.


As I’ve written before, this would not be so much a problem if their various speech codes were used merely to prosecute men such as David Ahenakew, Ernst Zundel, Jim Keegstra and the like. But in the post-9/11 era, radical anti-racists are also agitating to shut up sensible people saying sensible things about the war against militant Islam, the defining global struggle of our era. They’re also giving comfort to Islamists who seek to carve out sectarian taboos from our hallowed tradition of free speech.


All of this would be destructive enough on its own. When the censors start churning out the hate speech themselves – that makes them as much a farce as a menace.

I am not convinced that RW does not believe what he wrote about Sen. Cools. Those words came to him very easily it seems

We have seen his Hate in action in the videos about David Icke; why would this case be any different?

The problem with making accusations is that they can come back and bite you. I hope he has plenty of bandaids because he may need them.

July 28, 2006 must have begun as a normal day for Pamela Waechter, but it ended horribly wrong. She died at the hands of a gunman at the Seattle Jewish Federation where she worked as a campaign director. Her crime, and that of five wounded co-workers, was being Jewish.

In 2004, Statistics Canada issued a report detailing hate crime activity in Canada based on information provided by 12 major police services. It noted that 928 incidents targeting specific groups took place in 2001-2002, including mischief, assault and threats. In Toronto, the number of such crimes between 1993 — when police began tracking hate/bias crimes — and 2006, neared 3,000.

Farber and Rudner are doing precisely what Jonathan Kay described - they are fetishzing hatred.

Like the typical timorous, fearmongering liberals they are, they presume hatred all around them. They are still living in the '70's and '80's, when the enemies of the Jews really were so-called neo-nazis and white nationists. Today, they ignore the real antisemites in society; the ones who burned down tyhe Jewish Day School in Montreal, and who continue to vilify Jews in our society.

The neo-nazis and White Nationalists are picayune in comnparison with our new crop of hatemongers.

Farber and Rudner are living in the past and fetishzing hate.

What isn't in the least banal about this piece is that Farber & Rudner have managed to avoid reference to the real threat posed by Islamofascism. Why the silence when B'nai Brith has been actively involved in attempts to censor a Pro-Palestinian internet site via the CHRC that it considers to be unduly critical of Israel, a site whose articles it claims have crossed the line of hate speech violations? Examples cited include :“The idea that Israel has no right to exist or that Israel is an apartheid state”. Newsflash guys, I can visit virtually any progressive/leftist blog and run into this stuff, heck it's a staple at Rabble.ca. Hell I think Judy Rebick may even have a tattoo like that, Ewwwwwwwwwwwwwww.

This is pure speculation on my part but I am given to wonder if the whole Basement Neo-Nazi Hunt was simply a means to an end. Was the goal to test the elasticity and sticking power of Section 13 (1), to set precedents that could then be applied against other enemies? The Neo-Nazi's are virtual pariahs and hence a fine target, who wants to be seen coming to their aid? Right Warren?

Why do Farber & Rudner cite the tragic death of Pamela Waechter, but fail to mention that she died at the hands of anti-Israel shooter Naveed Haq, who it should be rightly noted may have been suffering from mental illness? Failure to mention that Haq is Muslim and a Fanatic can't have been a charitable omission on the part of Farber & Rudner, otherwise why cite this example at all? Why the politically correct chill? The failure to discuss the threat of Islamofascism openly destroys the credibility of their defense. A whole raft of hate crimes statistics are also trotted out, without analysis, proving once again - nothing.

Finally Farber & Rudners defense of the Warmanization of hatred, hits a near hysterical pitch with the recital of the now familiar trope that opponents of Section 13(1) want to eviscerate the Canadian Human Rights Act. No not really guys. We just want to make sure that Section 13(1) is eviscerated, so the unscrupulous members of society won't use it against you and the rest of us.

My submission:

Section 13 (1) of the Canadian Human Rights Act prohibits . . . . "any matter that is likely to expose a person or persons to hatred or contempt" . . .

The notion that a person can be held guilty of potentially hurting some unnamed person's feelings sometime in future is nauseous.

Moreover, the purpose of the Canadian Human Rights Act is to extend the laws in Canada to give effect, within the purview of matters coming within the legislative authority of Parliament, to the principle that all individuals should have an opportunity equal with other individuals to make for themselves the lives that they are able and wish to have and to have their needs accommodated, consistent with their duties and obligations as members of society.

There is no provision in the purpose of the Act to protect groups, sorts, or communities of people, but to protect the equality of opportunity for individuals.

We have Criminal Code provisions to deal with acts of hatred that endanger life and limb such as incitement to genocide, and further Criminal Code provisions to extend punishment for other crimes if it can be shown that those crimes were motivated by hatred.

The tiny and sorry minority who spout demeaning and degrading commentary respecting others need and deserve to hear the disapproving roar of millions of Canadians.

Silencing individuals who spout repulsive vindictive is dangerous, particularly when done through an arm of government. What Farber and Rudner propose is no better than the totalitarian censorship that led to two world wars; the only difference being that they are now the censors.

Irrespective of who acts as a censor in peacetime, our freedom of expression is extinguished and the stage set for silencing whatever critics Farber, Rudner and their ilk (or their successors) choose. These unelected busybodies need to be put in their proper place without delay.
