I was doing a bit of surfing the other morning and I happened to click on a link for www.lyingjackal.com.

I was not surprised to see that Warren Kinsella was taking a keen interest in the fundraising efforts of those who are continuing to fight the Human "Rights" SLAPP defamation suits instead of dutifully laying their heads on the chopping block.

Well, I have a suggestion of my own for the dynamic Warren/Warman duo: get with the program, ladies.

Richard Warman filed the first preposterous SLAPP suit against us last December, and, almost immediately, he began missing deadlines. This, despite the fact he was the one who chose to use the fast track "Simplified Procedure".

Warman missed the 90 day deadline for mediation, and 30 days after the 150 day case deadline, he was served with a 45 day notice of dismissal for abandonment. It wasn't until 17 days after that notice was served that he suddenly woke up and hired two lawyers. Our lawyer hadn't heard one word from him since she took our case in early March.

Now, finally, Warman's lawyers have set the matter down for trial.

The case with Warman and Kinsella is getting just as bad. They haven't even filed their Affidavits of Documents.

One would expect that two people, who are allegedly so worried about their reputations that they are driven to sue us, would be chomping at the bit to get to Court and get this thing resolved. Instead, they are missing deadlines in the procedure they themselves chose.

Now, if I was a suspicious person, I would think that Kinsella's angry rant might be an indication that the real plan is to use the SLAPP suits to drive defendents into financial ruin, and that he is expressing frustration because, with the help of supporters, the defendents keep slipping their heads out of their respective nooses.

The only alternative option is that Kinsella's rant was unrelated, but that he and his lawyer are so incredibly disorganized that they can't even manage to meet the deadlines that they have chosen to impose on us...despite the fact that he supposedly believes his reputation is in grave peril.

Since Warren has spent the past few weeks making lame home videos for his blog and touring with his cringe-worthy band of old guys, I think I'll go with Occam's Razor.

Kinseela may be complaining to Revenue Canada to try to get you, Ezra, SDM and FFF assessed taxes on donations that you have received. He does not know his arse from his elbow if that is the case. Gifts are not taxable in to my knowleddge.

...and why are the complainants not held to the letter of the law? If they fail to respond their complaint should be immediately dismissed. If a defendant failed to respond in time they would very quickly find themselves convicted and sentenced!!!!!

This irritates the crap out of me, FF. Simplified Procedure was created to streamline the process so it was over quickly and costs would be kept to a minimum. Yet it seems the rules mean nothing. The plaintiff can drag his feet as long as he likes, and the rules seem to be routinely brushed aside. Mad

Interesting that Ms Kinsella posted the above after sleeping on these words and similar from other posters on Ezra's blog, notice the time stamp:

The main question to be answered is:

How does the Warman strategy of "maximum disruption" differ from state-sponsored persecution of a political party or at least class (the real conservatives of Canada) and why doesn't the in-name-only Conservative Party step in to end this farce before it turns uncivil, which is a distinct possibility if people have to go through years of expensive litigation -- at xome point, somebody is going to consider cutting their losses in some more effective way than enriching lawyers, something most sane people hate to do on first principles.

My opinion continues to be this -- Warman and a few of his buddies want social revolution, are practising social revolution, and know the possible consequences of social revolution. They should do the math and stop this senseless campaign which is really just the open harassment of Canadian conservatives for private amusement, nothing more dignified or worthy of admiration.

Our judicial system is being steadily brought into further disrepute by all of this, and when you combine it with the sort of casual and almost random termination of a troublesome visitor at YVR last summer as though he were some sort of sub-human life-form, it makes me think that Canadians need to give their heads a real good shake and start all over again before we cross the arbitrary line and become a police state.

The idea of these noble lefties accelerating our decline into fascism is both morbidly fascinating and humorous were I not their fellow citizen. Well, technically, I don't consider my citizenship to be valid any more after seeing our constitution dismantled by the illegal and unconstitutional parliaments of 2000 to 2005. That's where the trouble lies -- in those two governments elected against the will of two-thirds of Canadian citizens and passing laws for the private amusement of ultra-leftists with no regard for our history or traditions.

To call them all traitors is not too harsh unless you're enjoying the post-habeas-corpus version of Kanadar.

This gives weight to my contention that the whole business is politically motivated and is the only way these clowns think they can actually win the debate, by putting a price on our free speech and our freedom to voice dissent against the results of the illegal parliaments of 2001-05, the ones that Warren Kinsella supported more than almost anyone else in Canada because his idol Chretien was in charge for most the time and launched all the despised and unpopular legislation that flowed out of those regimes.

Speaking of "get a job, losers" -- isn't this Warman's job, to enrich himself and now apparently his friend Kinsella, by launching frivolous and dragged-out lawsuits against targets whom they hope will settle out of court to avoid paying the legal bills, while they use taxpayers' money to fight their side of the case?

Of course it is easy to get a job when you have every civil servant in Ottawa and Toronto on your speed-dial. Those people are mostly Liberals from the ancien regime and they are trying to outlast Harper.
