BREAKING - CHRC responds to motion on secret hearing!

Postby Connie Fournier » 03/ 20/ 08 12:58 am

<center>CHRC response to motion on secret hearing</center>

Once again, Free Dominion is in the bad books of the CHRC.

As you can see from the attached leaked documents, the CHRC has seized on comments made on Free Dominion to attempt to convince the Tribunal to keep the public out of the hearing on March 25th.

The CHRC says it is worried because "a great deal of anger has been expressed on various websites, particularly against Mr. Steacy". I am not sure how we were supposed to react when we found out that a government agent had infiltrated our group, but it is interesting that, despite all of that alleged anger, all of the quotes that they included in their response letter come from one individual who has already said he is not planning on attending the hearing.

In any case, it is the Tribunal that has the final say on the matter, so we'll see if we are allowed in, or if we have to watch a video feed from another room. At least it sounds like we will be allowed to watch.

Spread it around!

These so-called security concerns are pure theater. The only violence associated with this case has been from the thugs in the ARA, Richard Warman's buddies.

There is no valid reason to bar the public from witnessing this hearing live.

What this comes down to is the CHRC is citing a couple of posts made by one individual as cause enough to keep the hearing semi-closed. The biggest problem with this is that it perpetuates the myth that there ever really was a security concern.

There never has been a genuine security concern. This is all theater put on by Warman and the CHRC to promote the image that Canada is really a country seething with Nazis just waiting to come out of the woodwork to attack government agents.

This is the same garbage they have been piling on Marc Lemire. It was lies then and it is lies now. But this time people are watching.

This is typical leftist provocation behaviour, like what you see on picket lines when someone theatrically falls over and claims that they were "attacked" by "scabs" when in fact they were the ones violating the law and trying to prevent lawful commerce.

We need to understand that we can't beat these courts at their game. We need to end the game. The way to do that is to put all the pressure on the Harper government to end the extra-legal activities of the HRC tribunals and their agents.

The situation is clear. We have a very substandard law (section 13) enabling leftists to set up their own parallel legal structure (the tribunals) and shake down conservatives for being conservatives.

There have been no real crimes, no real hate except for their hatred of us which is really a displaced self-loathing. Once we all understand this, I think the way to move forward is to engage in passive resistance to their activities. Do not enable them, stay away from them and ignore their deliberations. Anger against them will just lead to frustration.

However, at some later stage, if social revolution goes unchecked by the legislative branch of government, then we have a situation of constitutional anarchy, and the citizens would be legally and morally entitled to take whatever actions they saw fit, to defend the constitution.

Although we don't have the provisions of the American constitution in force here, we do have the same traditions, and if these social revolutionaries want to dabble in communism at our expense, then they need to learn that it is not consequence-free.

Well, it's a partial victory so far. The CHRC has backed down a bit, and will allow the public to watch the hearings from another room - but without being able to see the CHRC witnesses themselves.

Some of the CHRC's arguments make little sense. For example, they're trying to use the fact that transcripts contain descriptions of the CHRC witness' appearance to get a publication ban on further details about Dean Steacy's appearance. Well, TRANSCRIPTS ARE PUBLIC DOCUMENTS - and the CHRC never argued that they shouldn't be made public in the first place.

From the transcripts, we learned that Dean Steacy is a visually impaired man with a cane. Yeah, that really narrows it down and puts his life in danger. I'm sure there aren't any other visually impaired men with canes in Ottawa.

The Tribunal rightly denied this request back on March 9. The Tribunal should deny it again. It's simply unenforceable.

The existing camera ban ought to be sufficient. If properly enforced, the CHRC witnesses' pictures won't be posted on the Internet. Mere words describing their physical characteristics ought not to give the CHRC witnesses' identity away.

And this line is a whopper:
The Commission continues to support the principle that the public should have as much access as is possible to Tribunal proceedings.

The Commission initially tried to bar the ACCUSED from the hearing room when Commission witnesses testified - and everyone else but counsel. That wasn't supporting the principle that the public should have access to Tribunal proceedings - it was supporting the illiberal principal that accused persons ought not to be able to render assistance to counsel or directly confront their accusers.

Witnesses in many cases are controversial. Yet they testify at open hearings every day. Why should CHRC employees be treated any differently? In other cases, the CHRC has OPPOSED efforts to close hearings to the public on sensitive employment matters. What's good for the goose is good for the gander.

At the end of the day, assaulting Dean Steacy - or anyone else - is a crime. Anyone who does ought to be arrested and prosecuted to the fullest extent of the law. Period.

Corrections:
1) The Tribunal rightly denied this request back on MAY 9, not March 9.

2) Looking back at the cases I bookmarked, I probably shouldn't have said the CHRC opposed efforts to close hearings - usually, it was one of the other interested parties. But the principle still stands - the Tribunal generally REFUSED to close the hearings to the public.

Example 1:
<a href="http://www.canlii.org/en/ca/chrt/doc/1992/1992canlii1429/1992canlii1429.html">Bouvier v. Metro Express</a>, 1992 CanLII 1429 (C.H.R.T.)
Accused's counsel moved to close the hearings in a sexual harassment case. The CHRC didn't object. Nonetheless, the Tribunal left the hearing open.

Example 2:
<a href="http://www.canlii.org/eliisa/highlight.do?text=human+rights+act+%22section+52%281%29%22&language=en&searchTitle=Search+all+CanLII+Databases&path=/en/ca/chrt/doc/2003/2003chrt12/2003chrt12.html">Day v. Canada (Department of National Defence)</a>, 2003 CHRT 12 (CanLII)
The Department of National Defence moved to close the hearings in a sexual harassment case. Complainant objected. The Tribunal refused to close the hearing.

Excerpt:
These days, whenever I hear of bigoted or hateful comments by someone with a name like "Edward Kennedy" on a website (FreeDominion) that the CHRC just happens to be targetting -- comments that just happen to be legally useful to the CHRC -- my first thoughts are of, well, Dean Steacy himself. Like his friend Richard Warman, Steacy has confessed under oath to posting provocative or downright bigoted comments on websites he was hunting, using fake names.

No, the hearing will go on. All this is, is the CHRC asking the Tribunal to make spectators sit in another room. The Tribunal doesn't even have to go along with it if they don't want to. The CHRC tried this before (asking that Marc Lemire be removed from the room), but the Tribunal wouldn't go for it.

The creepy part about this (to me) is that one of the issues to be discussed at this hearing is about Steacy, a government agent, lurking and sneaking around Free Dominion. The CHRC's response to our anger over this is to send someone here to lurk and sneak around printing pages that they can try to use to keep us out.

The sleaziness doesn't end.

-------------------------------------------------------------------------------------

The problem with society is that the sheeple are afraid of the system. Whether the system, and in this case, IHC's like it or not, the fact is that some of us are not sheeple, and are not afraid to say what we are thinking. I am one of those types, what is the use running around life trying to appease the fascist politically correct people by either being silent or worse still, like some, agreeing with their attacks on freedom.

Years ago people would have crucified anyone who persecuted others for having an opinion, what has happened in the interim? Why have the people become the sheeple, a mindless grazing herd as you will, letting themselves be herded here and there by the whip wielding "New Taliban" typeset organizations and useful idiots of tyranny?

Several weeks ago, I told E2 and COnstance I was going to use my real identity. Why?

I was actively responding to a post of another here much less flammable than I, who had done the same, and I thought it was a sensible thing to do. I was angry thinking that the enemy actually had people so fearful that they would not dare post under their actual names. Of course, there are some here who do post under their real names, so I took the initiative to do so as a statement to the enemy, that I am not intimidated by their threats, their cowardly tactics, and by so doing challenged them to come and get me. I maintained the same posts Backwoods made and anyone who cared could have easily identified this reality. My style of course was/is a dead giveaway.

Now nobody had any doubts that sneaks and cowards would pick up on any comments made as excuses for the operation of their fascist organization in secret, after all, cockroaches do not like the light. My purpose was/is to be an indicator of just what are the feelings of many people who confide their anger, hatred and disgust about the state of affairs, but who are afraid to say it. I am not.

Now to the info that steacy has a cane and is sight impaired, I would say he needs to be protected, not from me, anyone here, or from any dissenter of the hrc agenda, but from leftists and politically correct peons. How so? Because the reality is that our side would not pick on such a pitiful person, and would be pitied in his infirmities. The lefties however are well known for their cowardliness in attacking only those who are vulnerable and alone, vis a vis such clowns as ara. Only lefties would attack someone who uses a cane and has other impairments. To boot, such hrc stooges are pitiful.

I am torn when I consider such individuals as steacy, between feeling sorry for them or for hating them. Consideration of them generally results in me feeling disgust, disrespect, and contempt towards anyone who would sell their soul to a "muscovite" mentality, betraying good people whose only crimes are to have an opinion au contraire to the present day "New Talibanic" freedomphobes, and tyrants that go by the name of Human Rights Commissions.

One wonders how such people can look in a mirror without puking, considering their work description. The thought of these people sickens me and awakens feelings of instant nausea. These people are the murderers of freedom and democracy, the "New Inqisitors", the "New Taliban" come to depose all that is good and substitute in it's place all that is evil. They are the scum who delight in the murder if innocent unborn babies, the spawn of evil who would plunge democratic nations into a new "Dark Age", the antithesis of all that is pure, good, free and sublime. These are those who are spilling the pure blood of freedom, and seek to slay her, installing in her place a fascist think regime that would put mgabe's operation to shame.

So I say to the cowards lurking here again that you have much more to fear than I, much more to fear than words I do not fear to openly say, feelings I do not hesitate to openly express. What you should fear is the secretive anger, hatred, disgust and bitterness that lies in the very being of the many who nurse these feelings but do not say them, for the fear they have in being able to do so, which translates into oppression, and as we always know oppression gives way to intense feelings of hate that eventually explode into violence. Do not fear the man who speaks his mind, instead fear he who dwells on his system imposed tyranny, who smiles in your face, but stabs you from behind. But you cowardly lurkers and spies already know this, it is how you operate.

One final word, I could not possibly attend, for while I can stomach the smell of decomposing carcases, fetid water, and animal innards, I could never stand the stench of hypocrisy, lying, cowardliness, phoniness, and tyranny, which I know permeates any building your types even casually attend.

There Constance, was that enough "control" for everyone? I can understand the hand wringing that some more "couth" people have here over my comments, but never let it be said I did not say what I felt.

The pitiful hrc's and their stooges do not have to worry about me attacking any of them, but as I said before, it is only a matter of time before they pick the wrong person and suffer severe consequences. That person will either be someone fabulously rich and able to buy any sort of justice he/she sees fit, or someone who has nothing to lose, and perpetrates an attack so profoundly destructive that havoc will be wrought on the tormenters. Obviously hrcs, and their stooges have lived sheltered lives and not been exposed to people capable of such actions. That is because they have dealt with people who are not violent, who are model citizens; hrc's have targetted Christians and people of principle. Were they to target people like themselves parrotting political correctness, they would find otherwise.

Be that as it may, we can expect tyranny to always be on the prowl, for as history has shown, it has always been, and will always be a fight between good and evil, right and wrong, decency and obscenity, Heaven and hell. Hrc's are undeniably of the latter.
Please let me know if I said something that offended you. I may want to offend you again sometime.
