Lemire's March 25th Hearing to be a Secret Star Chamber!
As many of you know, Marc Lemire's Canadian Human Rights Tribunal hearing is scheduled to resume on March 25, 2008.
The defence team is planning to question Dean Steacy, a Human Rights Commission investigator, about why he registered on Free Dominion when we were not under investigation (something he claimed never to have done), and to ask about the CHRC complaint that was lodged against us over a post that was made just days after Steacy registered here.
I sent the following email to Carol Ann Hartung on March 6th:

The transcripts will be public, but who knows how long it will take for the CHRT to release them.

The ruling regarding who was entitled to attend the CHRC members' testimony is here.
From what I understand, the CHRC originally wanted to keep Lemire outside the hearing room when the CHRC witnesses were testifying. The CHRT rightly denied that request - imagine being a defendant in a criminal case and not being entitled to participate in your own defense. That's what the CHRC tried to do here in a quasi-criminal case.
I'm not 100% sure that an order to hold the CHRC witnesses' testimony in camera was entered as part of that written decision, though - just an order that no one brings a camera into the hearing room. |

Well in case they read this, then I would take the opportunity to tell them that I think they are all a bunch of bigotted, Christophobic, heterophobic, Whiteaphobic tyrannts, the best of the lot of them I would not piss on the best part of. CBC needs to broadcast this in real time. The
mandate of the CBC has always been to draw us
together. Broadcasting this hearing would bring
us all together in appreciation of the good work
our tax dollars do for us.
If safety is a concern those in charge could follow
procedures used in trials of biker gangs.
Connie Fournier doesn't look scary to me, but I
come from the west. |

The CHRT's in camera ruling was made before any CHRC witnesses were heard on May 9. It appears that the Tribunal was worried about pictures of the CHRC investigators being posted on the Internet. Paul Fromm raised objections to the motion, but was overruled.
I suppose a media organization or bloggers could file some sort of motion to open the proceedings to the public. Given the CHRT's ruling and concerns about keeping investigators' physical attributes secret, allegedly for their safety, it might make more sense to request the ability to listen to oral testimony in some sort of overflow room.
By the way, according to the CHRT's website, the Tribunal is no longer making written transcripts available in the normal course. Instead, a CD-Rom of audio testimony will be provided to the parties upon request. |
