Does anybody know the technical legal definition for extortion ?

We have done some searches of IPs from emails we've received from Richard Warman. Most of these emails arrived during regular working hours and several bore an IP address that leads to 100 Constellation, Ottawa.

This address appears to house the Provincial Courts and the Ottawa municipal offices. Does anyone from Ottawa know if the DND also has an office there?

f. The Defendants have published threats of violence against the Plaintiff.

The Plaintiff pleads that as a result of the Postings, his personal and professional reputation have suffered; the Plaintiff has been brought into ridicule, scandal and contempt both personally and by way of his professional as a lawyer, the Plaintiff's livelihood has been threatened; and the Plaintiff has suffered damages.

142. The Plaintiff states that the conduct of the Defendants towards him has been malicious, reckless and reprehensible and in complete and total disregard for his personal and professional reputation and that such conduct warrants the imposition of aggravated and punitive damages.

143. The Plaintiff pleads and relies on the Libel and Slander Act, R.S.O. 1990, c-L.12.

OFFER TO SETTLE BY PLAINTIFF

The Plaintiff offers to settle this proceeding with Constance Wilkins-Fournier and Mark Fournier ('Defendants' for the purposes of this offer to settle) on the following terms:

1. The Defendants will pay the Plaintiff the sum of $10,000.00 for general, aggravated, and punitive damages.

2. Within one week of accepting this offer, the Defendants will remove or have removed the words that are defamatory and libellous to Richard Warman from their website and any other websites where they have published defamatory and libellous material about Richard, Warman. Within one week of accepting this offer the Defendants will also publish a retraction of all of the material alleged in this claim to be defamatory and libellous to Richard Warman. The Defendants will also publish in the same means as the libellous material was originally published, to any and all others to whom the Defendant may have sent the defamatory material. All retractions will be published with as much clarity and prominence as the defamatory and libellous words were published.

3. If the Defendants accept this offer prior to December 13, 2007 at 5:00 pm the Defendants will pay $900.00 in costs to the Plaintiff. If the Defendant accepts this offer after December 13, 2007 at 5:00 pm the Defendant will pay the Plaintiffs' costs incurred after December 13, 2007 at 5:00 pm to the date of acceptance on a substantial indemnity basis as agreed by the parties or as assessed.

4. This offer is open for acceptance until it is withdrawn by the Plaintiff or until 5 minutes after the commencement of the trial of this matter.
