Some of the lawyers looking into this are at the moment deciding how much I should publish here. I really want to put up the whole text of her absurd complaint but for the time being I will generalize.
The most ridiculous part of all is her claim that she, herself, was discriminated against. She opens with that and afterwards does nothing but cite how mean Bill Whatcott is to Muslims. She actually states that she isn't a Muslim, and never explains how it is that she was discriminated against.

Marie-Line Gentes a wildlife biologist who studied at the University of Saskatchewan and now teaches at Vanier College in Quebec. She obviously has a serious hate on for Bill Whatcott and Free Dominion is caught in the crossfire.
The odd thing is she isn't whining about what everyone would expect, she is whining on behalf of her poor Muslim brothers and sisters. I guess she figures they are too stupid to act on their own behalf so she will condescend to do it for them. |
Do you know exactly which post it is? I don't follow Bill's posting very carefully, but I thought he was more "into" homosexuality than radical Islamicism. |

I'm trying to remember the last time Bill made a comment on Muslims.
The complainant seems like a real wierdo. She's going to get a lot of publicity out of this - whether she wants it or not.

many HRC's have relaxed rules of evidence, as do many other tribunals such as labour boards. they aren't unconstitutional and can even help the respodent to the complaint, depending on the evidence. Nor do they operate outside the authority of the courts - the courts can review an incorrect determination regarding the way evidence was considered.
There's no criminal penalties under HRC statutes - you can't be sent to jail as a remedy for a Human rights breach. Nor are there generally reverse onuses. Some individual issues may have shifting burdens of proof, but there's no areas where a mere accusation leads to a requirement to disprove it.
Absentia findings of breach would be rare, especially where the other party actually wants to show up and defend. I suppose if one party continually ignored hearings and refused to show up, a judgment might issue without their input, but it would be odd to be denied the opportunity.
And ignoring an HRC complaint because you misunderstand the scope of their authority, as you suggest to do, is a very very BAD idea.
I suspect you've heard some things and just interpreted them incorrectly, or you've (mis)read Ted Morton on the subject. No biggie, just thought I should clear things up. |

This is not quite true. The HRC can't say you have violated the Act and as a result you must go to jail. Yes in theory you could go to jail after long periods of non-compliance with a human rights determination. But then it would be contempt of court. Heck, you could theoretically go to jail for not paying your credit card bill.
If your expansive definition were true, than every proceeding in existence would be a criminal matter, because the possibility would exist that an order would be issued that would not be adhered to, which could later result in a contempt finding. |
