THIS ACTION IS BROUGHT AGAINST YOU UNDER THE SIMPLIFIED

CLAIM

1. The Plaintiff claims:

a. General damages in the amount of $50,000.00;
b. Aggravated damages in the amount of $50,000.00;
c. Punitive damages in the amount of $50,000.00;
d. A complete public retraction of the defamatory comments to be published on the Defendants' website;
e. A permanent injunction restraining the Defendants from continuing to libel the Plaintiff;
f. Pre-judgment and post-judgment interest in accordance with the Courts of Justice Act, R.S.O. 1990, c. C-43, as amended;
g. Costs of this action in accordance with the Rules of Civil Procedures, R.R.O. 1990, Reg. 194 as amended; and,
h. Such further and other relief as this Honourable Court deems just.

2. The Plaintiff, Richard Warman ("the Plaintiff'), is a lawyer and resides in the city of Ottawa, Ontario.

3. The Defendants, Constance Wilkins-Fournier and Mark Fournier ("the Defendants") were and are, at all times relevant, the owners and operators of the website www.freedominion.ca. They are responsible for postings defamatory to the Plaintiff on the website www.freedominion.ca. The Defendants are also responsible for the publication of extensive material made by anonymous others in various discussion threads on the website www.freedominion.ca. The Defendant John Does 1-8 are currently anonymous individuals responsible for the publication of one or more defamatory posting(s) on the website
www.freedominion.ca.

4. The First and Second Postings appear in the discussion thread entitled:

Publication of Material Defamatory to Richard Warman

11. On or about the month of August 2007 until but not limited to the month of November 2007, the Defendants published in Ontario and throughout Canada written words that are defamatory and libelous of the Plaintiff as part of postings on the website known as www.freedominion.ca.

12. The different postings (One through Sixty-Two) (the "Postings") contain false statements that discredit the Plaintiffs personal reputation and, more specifically, his professional reputation as a lawyer.

The First Thread "Gentes/CHRC withdraw complaint against Free Dominion."
Posting 1

13. The Plaintiff complains of the following words, as were posted on the Freedominion website by klinxx on 7 August 2007 at 8:15 am:

"Richard Warman: Censorship Champion"

"This asshole is so obnoxious that even his fellow fanatics at the "Human "Right" Commission couldn't stand him"

14. The Posting in question contains serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff is the Censorship Champion;
b. The Plaintiff is a fanatic and so obnoxious that even his fellow fanatical colleagues at the Canadian Human Rights Commission couldn't stand him.

Posting 2

15. The Plaintiff complains of the following words, as were posted on the
Freedominion website by klinxx on 7 August 2007 at 9:45 am:

"Ottawa 'human rights lawyer' wants Canada's Internet to be more like China."...

"Richard Warman has been opposed to the Freedom of Speech afforded by the Internet for years, levying threats against independent media sites. Inevitably his crusade has lead to people offering unlawful death threats against him."...

"By threatening this person, and threatening anyone who tried to publicly expose Mr. Warman's activities, Mr. Warman chose a life path that was inevitably going to escalate."...

"Until I personally read the actual text of the alleged death threats I won't be certain that they exist, given Richard Warman has falsely claimed unlawful speech in the past." ...

"Here is some information about Richard Warman for those who don't know the whole story. Richard Warman is involved with an urban terrorist group called the 'Anti-Racist Action' who he recently sponsored to go and protest in front of another individual's house, thus the Paul Fromm reference.

They picketed his street with masked faces and sticks and weapons. the cops acted as a barrier between them and Mr. Fromm's house. This group of individuals that Richard Warman has given speeches to and financed, were also responsible for the firebombing of another individual's house, including the posting of instructions to do it. (link with news articles and pictures on the ARA, including the firebombing, and articles about them attacking police horses' eyes with sharp sticks during protests provided."...

"While they were protesting however, a member of the group was holding up a sign that said, "Thank you Richard Warman for the bus rental" and another with "Die Nazi Scum"" ...

"Also, Paul Fromm has been doing free legal defense work for individuals that Richard Warman files complaints against." ...
"Richard Warman was also videotaped counciling members of the ARA to commit assault against David Icke, a previous Green Party colleague, that was on a tour signing he latest book because he didn't agree with what he was writing."

"He has affected other peoples' lives and threatened their safety as well on many occasions. You live by the sword, you die by the sword." ...

16. The Posting in question contains serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff wants Canada's Internet to be more like China.

b. That the Plaintiff has been opposed to the Freedom of Speech afforded by the Internet for years and that my crusade in this regard inevitably led to death threats against the Plaintiff.

c. That the Plaintiff attempted to censor David Icke, threatened him, and then threatened anyone who tried to expose my activities.

d. That the Plaintiff is a liar, he has made false allegations of unlawful speech in the past, and therefore the Plaintiff s allegations of death threats/incitement to murder him from US neo-Nazi Bill White should not be believed.

e. That the Plaintiff is involved with and has financed an urban terrorist group.

f. That the Plaintiff was videotaped counseling the commission of the criminal offence of assault.

g. That the Plaintiff has affected other peoples' lives and threatened their safety as well on many occasions.

The Second Thread
"Richard Warman attacks free speech, Free Dominion BREAKING"

17. The Plaintiff complains of the publication of the entirety of the libel notice dated 10 September 2007 and containing the following words, as were posted on the Freedominion website by Connie Fournier on 18 September 2007 at 9:35 pm:

The web-page article entitled, "Gentes/CHRC withdraw complaint against Free Dominion"

1. Accuses me .of being the "Censorship Champion".

2. States in reference to me that "...this asshole is so obnoxious that even his fellow fanatics at the "Human "Right" Commission couldn't stand him"

3. Accuses me of being a "professional complainer".

4. Accuses me of being a "devious character".

5. States that I have been "...opposed to the Freedom of Speech offered by the Internet for years".

6. States that "[i]nevitably his crusade has lead [sic] to people offering unlawful death threats against him."

7. Accuses me of having threatened David Icke and also of having threatened "anyone who tried to publicly expose [my] activities".

8. Accuses me of having made false allegations of unlawful speech in the past and that the concerns I expressed publicly about the incitement to murder me from US neo-Nazi Bill White should be doubted.

9. Accuses me of being "involved with an urban terrorist group called the "Anti-Racist Action" who he recently sponsored to go and protest in front of another individual's house, thus the Paul Fromm reference."

10. Accuses me of having spoken to and financed the Anti-Racist Action group and that this group was responsible for "...the firebombing of another individual's house, including the posting of instructions to do it" and that this same group attacked the eyes of police horses with sharp sticks.

11. Accuses me of having sponsored bus transportation for a protest by this same Anti-Racist Action group outside the home of Paul Fromm at which a protestor held a sign stating "Die Nazi Scum".

12. Repeats the libel of Paul Fromm in calling me a "censor".

13. Accuses me of having sponsored bus transportation for the group Anti-Racist Action to the protest outside the home of Paul Fromm in retaliation for Paul Fromm acting as agent for respondents in federal human rights cases that I have filed.

14. States that I counselled members of the group Anti-Racist Action group to commit an assault against David Icke because I didn't agree with what he was writing.

15. States that I have threatened the safety of other people on many occasions.

16. States that my action in bringing an application before the CRTC in relation to the threats of US neo-Nazi Bill White is reflective of a dictatorship.

18. Accuses me of being controlled by someone else or by some other group - "the proxy by which the B'nai Brith, CJC, CHRC works through."

18. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff is a censor and the Censorship Champion;

b. The Plaintiff is a fanatic and so obnoxious that even his fellow fanatical colleagues couldn't stand him.

c. The Plaintiff is a professional complainer.

d. The Plaintiff is a devious character.

e. The Plaintiff has been opposed to the freedom of speech offered by the Internet for years.

f. The Plaintiff threatened David Icke and also anyone who tried to publicly expose [Plaintiffs] activities.

g. The Plaintiff made false allegations* of unlawful speech in the past and that the concerns Plaintiff expressed publicly about the incitement to murder Plaintiff from US neo-Nazi Bill White should be doubted.

h. The Plaintiff is involved with an urban terrorist group called the Anti-Racist Action whom he recently sponsored to go and protest in front of another individual's house.

i. The Plaintiff has spoken to and financed this same Anti-Racist Action group and that this group was responsible for the firebombing of another individual's house, including the posting of instructions to do it and that this same group attacked the eyes of police horses with sharp sticks.

j. The Plaintiff sponsored bus transportation for a protest by this same Anti-Racist Action group outside the home of Paul Fromm at which a protestor held a sign stating "Die Nazi Scum".

k. The Plaintiff counselled members of the group Anti-Racist Action to commit an assault against David Icke because Plaintiff didn't agree with what Icke was writing.

1. The Plaintiff has threatened the safety of other people on many occasions. ni. Accuses me of being controlled by someone else or by some other group.

21. The Plaintiff complains of the following words, as were posted on the Freedominion website by OC on 18 September 2007 at 10:05 pm:

23 The Plaintiff complains of the following words, as were posted on the Freedominion website by SaskBigPicture on 18 September 2007 at 10:06 pm:

"Jackbooted collectivist drones, read the following very carefully"

24. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff is a fascist, a jackbooted collectivist drone

Posting 6

25. The Plaintiff complains of the following words, as were posted on the Freedominion website by SaskBigPicture on 18 September 2007 at 10:10 pm: "Stones, Molotov cocktails, anything they can get their brownshirted hands on."

26. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff is a brownshirt, a Nazi.

Posting 7

27. The Plaintiff complains of the following words, as were posted on the Freedominion website by Droid1963 on 18 September 2007 at 11:19 pm: "Warman: The Destruction of Terry Tremaine (Mathdoktor) (...)

"Ottawa anti-free speech campaigner - he has so far filed 20 complaints against Canadians for comments on the Internet or for their websites - is a nasty piece of work. Oh, yes, he's suing CAFE and me for calling him an enemy of freedom and a censor."...

So, it's not enough to make a complaint to try to gag Mr. Tremaine. He must seek to have him fired from his job and livelihood. The destruction of Mr. Tremaine continued. Now, faced with the likelihood of never being able to work in his job a math educator, he began to drink heavily, contemplated suicide, fell into a depression and eventually had to check himself into a psychiatric institution for depression. Mr. Tremaine is now on the mend. At one point, last fall, Tremaine wrote what he called 'a groveling letter' of apology for his 'racist' views. 'As I said above, I considered the only alternative was my suicide. So, I truly felt between a rock and a hard place, not really wanting to kill myself' The anguish and humiliation of these lines reminds one of the destruction of Winston Smith in George Orwell's novel 1984. No doubt Warman is chortling at the mischief caused by his 'maximum disruption.' However, the evils inflicted on a gentle mathematician who dared to utter political thoughts on the Internet must not be forgotten. The attempt to destroy Terry Tremaine is the true face of Canada's Soviet thought police. I'm certain you are even more determined than ever to fight the thought control freaks in our midst, the 'human rights' commission censors and the special interest groups."

28. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff a censor, enemy of freedom, and anti-free speech campaigner;

b. The Plaintiff is a nasty piece of work;

c. The Plaintiff laughs at individuals with depression/mental illness who consider committing suicide;

d. The Plaintiff is a member of Canada's Soviet thought police and a thought control freak.


Posting 8

29. The Plaintiff complains of the following words, as were posted on the Freedominion website by conscience on 18 September 2007 at 11:31 pm:

I. Accuses me of being the "Censorship Champion."
The poster is of the opinion that Richard Warman is a felching fecalphiliac."

30. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff is the Censorship Champion;

b. The Plaintiff is a sexual deviant.


Posting 9

31. The Plaintiff complains of the following words, as were posted on the Freedominion website by free_life2 on 19 September 2007 at 12:18 am: "These types like Rickie want to silence us all."

32. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff wants to silence everyone.

Posting 10

33. The Plaintiff complains of the following words, as were posted on the Freedominion website by Connie Fournier on 19 September 2007 at 7:28 am:

"Ok, I contacted Marc Lemire and he has been helping me research the comments one-by-one. Here is where we stand at the moment. There area couple that we still need to research:

1. Accuses me of being the "Censorship Champion".

This is easy to prove. Of all CHRC cases since the 1970's. Warman has filed over 50% of all cases... Close to 30 now.

2. States in reference to me that "...this asshole is so obnoxious that even his fellow fanatics at the "Human "Right" Commission couldn't stand him"

3. Accuses me of being a "professional complainer".

He doesn't seem to do anything else.... And with as much time as he takes off for hearing what other possible job could he have?

4. Accuses me of being a "devious character".

5. States that I have been "...opposed to the Freedom of Speech offered by the Internet for years".

6. States that "[flnevitably his crusade has lead [sic] to people offering unlawful death threats against him."

Statements of opinion.

7. Accuses me of having threatened David Icke and also of having threatened "anyone who tried to publicly expose [my] activities".

Well he more than threatened Icke, he sued him and went on a mission to sue libraries in BC which stocked the book. In fact the BC government later had to pass a special bill to protect libraries from people like Warman sueing them over books in their collections.

8. Accuses me of having made false allegations of unlawful speech in the past and that the concerns I expressed publicly about the incitement to murder me from US neo-Nazi Bill White should be doubted.

Need to research this one.

9. Accuses me of being "involved with an urban terrorist group called the "Anti-Racist Action" who he recently sponsored to go and protest in front of another individual's house, thus the Paul Fromm reference."

He gave a keynote speech to them, which we have. As well members of the ARA held up a sign that read "Thanks for the Bus Rental Richard Warman"
Warman has been involved with the ARA for a while.

10. Accuses me of having spoken to and financed the Anti-Racist Action group and that this group was responsible for "...the firebombing of another individual's house, including the posting of instructions to do it" and that this same group attacked the eyes of police horses with sharp sticks.

CSIS was caught on video tape saying that the ARA firebombed Zundels case.

There are plenty of pictures of the ARA attacking horses. In fact the Toronto Police had to purchase special googles that police horses now wear because of the ARA hitting the horses in the eyes with sticks.

11. Accuses me of having sponsored bus transportation for a protest by this same Anti-Racist Action group outside the home of Paul Fromm at which a protestor held a sign stating "Die Nazi Scum".

There are pictures to prove this.

12. Repeats the libel of Paul Fromm in calling me a "censor".

He is clearly a censor, and that's a statement of opinion.

13. Accuses me of having sponsored bus transportation for the group Anti-Racist Action to the protest outside the home of Paul Fromm in retaliation for Paul Fromm acting as agent for respondents in federal human rights cases that I have filed.

There are pictures to prove it. But not any actual rental agreements which might conclusively prove that statement.

14. States that I counselled members of the group Anti-Racist Action group to commit an assault against David Icke because I didn't agree with what he was writing.

This is from a video entitled "The shadow" or something similar (we need to find that). In that video Warman gives the date time, etc. and Says it would be nice to throw a pie on Icke. It later did happen.

15. States that I have threatened the safety of other people on many occasions.

This needs research. I'm not even sure that this statement was made on FD.

16. States that my action in bringing an application before the CRTC in relation to the threats of US neo-Nazi Bill White is reflective of a dictatorship.

That's a statement of opinion.

17. In relation to the incitement to murder me by US neo-Nazi Bill White states that 11 ... jilf there is a serious physical threat, would it be because of activities fighting proven "hate speech"? Is there any truth to the allegations that he has taken his own believes to the streets? Allegations have been made about Mr. Warman engaging in some of the same physical activities, such as exposing the home addresses of his opponents, talking to their neighbours, and other such activities that Mr. Warman would be concerned if his opponents did to him. I don't know who is involved in the "Anti-Racism Action" group, but they seem to believe it is possible to fight "hate" with "hate".

Warman does support the "outing" of people he lays complaints against.

"Outing" is when violent members of ARA attack a private person's house. In this case - Paul Fromm's home was attacked.

Warman stated he is in favour of "outing" people in his speech to the ARA, which we have a copy of. (because the tribunal forced him to produce it). I will be posting a copy of this speech that was used as legal evidence in court.

18. Accuses me of being controlled by someone else or by some other group -"the proxy by which the B'nai Brith, CJC, CHRC works through."

34. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:

a. The Plaintiff is a censor and the Censorship Champion;

b. The Plaintiff is so obnoxious that even his fellow fanatical colleagues couldn't stand him.

c. The Plaintiff is a professional complainer.

d. The Plaintiff is a devious character.

e. The Plaintiff has been opposed to the freedom of speech offered by the Internet for years.

f. The Plaintiff threatened David Icke and also anyone who tried to publicly expose [Plaintiffs] activities.

j. The Plaintiff sponsored bus transportation for a protest by this same Anti-Racist Action group outside the home of Paul Fromm at which a protestor held a sign stating "Die Nazi Scum".

k. The Plaintiff counselled members of the group Anti-Racist Action group to commit an assault against David Icke because I didn't agree with what he was writing.

l. The Plaintiff has threatened the safety of other people on many occasions.

m. The Plaintiff supports the "outing" of people he lays complaints against and that 'outing' such people involves having violent members of ARA attack a private person's house. Further that this is what happened at a demonstration sponsored by the Plaintiff as described in 34(h-j) above.

n. The Plaintiff is controlled by someone else or by some other group.

Posting 11

35. The Plaintiff complains of the following words, as were posted on the Freedominion website by RedDog on 19 September 2007 at 7:39 am:

"I really think this individual, ultimately like all leftists, is more interested in controlling others while using unlimited public resources to do so."

36. The Posting in question contained serious allegations against the Plaintiff, clearly stating, in its plain and ordinary meaning or by virtue of surrounding circumstances which give the words a defamatory meaning inferentially or by innuendo that:
