Postby Connie Fournier » 04/ 27/ 12 1:48 pm

We just got the date for the Federal Court hearing on Richard Warman's copyright case against us.

It will take place on Monday May 28th at 9:30am at the Thomas D’Arcy McGee Building, 90 Sparks Street, Ottawa.

For those of you who are confused by all of the cases, this is the most recent case that Richard Warman has filed against us. He is suing us for alleged copyright violation over his Maximum Disruption speech, an article by Jonathan Kay for which he acquired copyright control, and a picture from his website that was hotlinked on FD.

Because of all of the lawsuits we are fighting, we were unable to find the money to retain an intellectual property lawyer to defend us in this case, so I have been representing us myself.

I think I have some very good arguments and I have submitted them all, but the hearing is where I have to present them orally. Needless to say, as a non-lawyer, this is a bit daunting.

So, this is an invitation to any FDers who might like to come and give us some moral support on May 28th. The Court is booked for the whole day, but I don't know how long it will really take. All I know is that it starts at 9:30am.

Please feel free to pass this around!

If enough people show up it should only take a minute or two to subdue Little Dickie Warbaby.

Connie, I owe an apology to you, Mark and fellow members of FreeDominion for posting the hotlink referenced, which bore the img url:
http://3.bp.blogspot.com/-GkMatw8P514/TpLoRwz1ZSI/AAAAAAAAEmw/jb1CH4a63S4/s1600/Ottawa-20110919-00078-1.png
Note that the size of this photo is 604 x 455, whereas the one at 'richardwarman.ca' is 648x485.

The hotlink itself came directly from the 'BigCityLib Strikes Back' blog site, which had mounted the picture at 8AM Oct 10, 2011, in a thread entitled Where Richard Warman's Money Goes.

That post was then mirrored at the 'Anti-Racist Canada' blogsite at 8PM Oct 10,2011, and held up for examination at FreeDominion the following day.
(I note that the 'hotlink' remains mounted on both 'BigCityLib Strikes Back' and 'Anti-Racist Canada' blog sites, whereas you had been contacted by Mr. Warman, and unmounted the img url at FreeDominion within hours of my mounting it to FreeDominion.)

The photo associated with the FreeDominion 'hotlink' is one of two found by googling "richard warman"+"wayne nightingale" 'images', and 'similar images'. (Mr. Nightengale is one of the three subjects in the photo)

Any reasonable person would presume than the person taking the photo 'likely' owned whatever copyright laws might apply, and that person would label the img url accordingly.

It's not possible to determine the providence of the photo hotlinked at FreeDominion, as the site in which it appears is 'Anti-Racist Canada', which only mounts posts under psuedonyms which begin with 'n' and end with '200', and the 'hotlink' in question is to the photo mounted at that site and 'BigCityLib Strikes Back'.

It is possible to show numerous links between 'N200, Michael J, Murphy (aka 'BigCityLib Strikes Back'), and Richard Warman, and in this case the copyright infringment suit confirms that "Anti-Racist Canada' is a de facto internet site published, at least in part, by Richard Warman.

Mr. Warman has launched several suits against FreeDominion, and the continual online malice posted against FreeDominion at Mr. Warman's 'de facto' blogsite 'Anti-Racist Canada', is sufficient evidence to warrant the claim that the 'copyright' suit is vexatious, and unworthy of the Court's consideration.

The spirit and intent of Mr. Warman's numerous attacks against you, by means of vexatious litigation and by scurrilous online demonization through 'Anti-Racist Canada' is unbecoming an 'Officer of the Court'.

Not to worry, Maikeru, hotlinking is not publishing. There is good case law for this.

In response to this, styky, we got an email from someone who wants to donate $1000 to the defence fund if FDers will match it.

This case is not costing us as much money because of our do-it-yourself approach, but the other cases continue to accrue costs, and we like to keep paying it down!

Then I'll drop a cheque in the post in the morning for $200. only $800 to go. ;)

FreeDominion is undeserving of the vitriol and malice posited by 'Anti-Racist Canada.
That blogsite warrants the broadest possible exposure as a site which was specifically created to demonize fellow Canadians under the guise of 'anti-racist' rhetoric.

The 'hotlink' complaint cements Mr. Warman's connection with an 'anonymous 3rd party' blogsite that mounts posts with the intention of influencing the legal litigation Mr. Warman has brought against FreeDominion.

FreeDominion hosts are beholden to restrain member comments that might be interpreted by the Courts as evidence of 'malice' towards the Complainant, Mr. Warman, which in turn might inflate any award derived from legal litigation.

The obverse of that coin is that Mr. Warman is equally beholden to restrain comments about ongoing litigation on his own site, even if under no legal obligation to restrain commentaries posted elsewhere, and subject to his close personal attention.

Recently, former FreeDominion member Harry Abrams contacted 'Anti-Racist Canada' to clarify the paraphrasing of a comment he left on on a thread which featured a 'smear by association' picture of political candidate Link Byfield alongside Paul Fromm.

Mr. Fromm was also involved in legal litigation with Mr. Warman, wherein Mr. Warman referred to remarks by Mr. Fromm as the "unrelenting campaign to ruin my reputation as a lawyer" and the damage done "...is like an oil spill on the water of my reputation, I don't know how to put a stop to it".

Actually, I'm not sure if the picture he is suing us over was on the ARC site or not, Maikeru. It was a picture of him in military camos with another guy whose face was blurred out.

Thanks, styky!

Hey Connie,

I owe someone very special a visit in Ottawa. This is a good excuse to go. It would be great to see you and Mark again too. Breakfast will be on me.

The last time we were together I ended up sitting between Lemire and BCL staring at Warman. Man, the situations you get me in to! I wouldn't want it any other way. :D

Maikeru I don't think that could be the cause.
For one think, you posted a link to an image, you didn't hotlink it.
For another thing, that post of yours wasn't made until 6 months AFTER Warman notified FD he was suing.

You are right, pirapoi. It was from a thread in May of 2010.
