On Thursday morning at 9:30am Mark and I will be in Federal Court in Ottawa. Richard Warman has sued us for copyright infringement and they have brought a Motion to try to have sections of my Affidavit stricken from the record before this goes to the final hearing.

This is an interesting case because Mark and I are representing ourselves. I know...fools for clients. But, we really didn't have the $10,000 to cough up for a retainer for an intellectual property lawyer, so we're doing the best we can.

We would obviously appreciate it if we could get some of our friends to show up and give us some moral support, but we realize it might be difficult for a lot of people because it is election day.

Anyway, if you want to come and see me try my best Perry Mason, we'd love to see you!

Unfortunately, I don't know the address for the Court. I will get that tomorrow and update this thread. Meanwhile, please pass this around!

Gee, seems out of necessity we are becoming lawyers in our own existences...I see a hearing on the horizon, a court appearance as well being an expert witness, and a stint, in addition, possibly to being my own representative, but in that, because I have a better knowledge and more passion of the situation than most lawyers out there.

Copyright law requires a specialized lawyer, and in my association years ago in that area, was told by a top law firm in Kingston I would have to go to Ottawa or Toronto to find one. That is still the case I think.

I lost my best influence and legal authority a few years ago when he passed away suddenly, he was not only a lawyer but became a Justice and was very discerning. He had been a mayor of the city and I met him when I did a hedge trim for his mother, and she insisted I do more work beyond the pale of the contract, for nothing. She called him and he came right away, and became a steady client of mine, and reference to boot. I did an estimate for a young gal called Rachel, who was very suspicious and when I gave her his name she pointed her finger in my face and said she knew this man personally and would all him about me.

I left, and a few days later, she called and told me to do the job. When we did, and she was making the cheque to me, she told me she had called him and he had said four words, "They are the best". I enjoyed his presence for decades and doing all tree work at his residence and cottage north of the city. He is one of those irreplaceable people that once lost, are missed the rest of our days until our own time comes to leave.

I have of course more lawyers in my client list and existence but not like him.

Yeah. This is just a motion within the case but it is important. The other side asked me to consent to striking out a large portion of my defence (in my Affidavit) or they would bring a motion to do it, and seek costs for having done so.

Since this is important to my case, I had no choice but to let it go to a judge and hope that he/she will allow me to keep it in.

The other side has no right to seek your approval for any diminishment of your case, for a judge to rule in their favor would be seen as prejudicial..why would anyone have the vapidity to expect their opponent to diminish their chances?

Maximum Disruption" strategy would seem to be a key point

Vexatious as in unmeritorious? How so? His documents, his strategy
Abusive? ha ha ha
Hearsay? Thought they were copies of court documents

Upon reading your reply to me above that he wanted something not heard, I immediately thought it would be as you state here....of course he does not want that to be presented, the facts are damming.
